1. Introduction
1.1 These Terms and Conditions (“Terms”) apply to all contracts for the supply of goods and services (including printing, design, promotional products, branded merchandise, leaflet distribution, and related services) by Bristol PRINT Services to the exclusion of all other terms unless expressly agreed in writing.
1.2 “Supplier” means Bristol PRINT Services.
1.3 “Customer” means the person, company, or organisation ordering goods or services from the Supplier.
1.4 By placing an order or making payment, the Customer accepts and agrees to these Terms.
2. Orders and Acceptance
2.1 No contract exists between the Customer and the Supplier until the Supplier issues an order confirmation or accepts payment for the goods/services.
2.2 The Supplier reserves the right to refuse any order at its discretion.
2.3 All descriptions of products and services are subject to availability.
3. Price and Payment
3.1 Prices quoted are in UK Pounds (£) and are exclusive of VAT unless otherwise stated.
3.2 Payment for all orders must be made in full before work commences unless otherwise agreed in writing.
3.3 Where credit terms are agreed in advance, the Supplier reserves the right to charge interest at a rate of 8% per annum above the Bank of England base rate, calculated daily from the date of invoicing until payment is received in full.
4. Delivery
4.1 Delivery dates are estimates only and not guaranteed. The Supplier will make reasonable efforts to meet agreed delivery times, including same-day or next-day services where specified.
4.2 The Supplier is not liable for losses caused by delivery delays beyond its reasonable control (e.g., courier issues, weather, supply problems).
5. Artwork and Proofs
5.1 Unless using the Supplier for design services, the Customer is responsible for providing artwork and content that is accurate and suitable for print.
5.2 The Supplier may provide proofs for approval before printing. Once the Customer approves a proof, the Supplier is not responsible for errors that appear in the final product.
5.3 The Supplier reserves the right to charge for additional proofing or changes requested after approval.
6. Cancellations and Changes
6.1 Orders may not be cancelled or amended once an order has been confirmed without the Supplier’s written consent.
6.2 If cancellation or amendment is agreed, the Customer may be liable for any costs incurred up to the point of cancellation or amendment.
7. Returns, Refunds, and Faulty Goods
7.1 Claims for defective or incorrect goods must be notified in writing within 7 days of delivery.
7.2 If the Supplier confirms a fault not caused by the Customer, the Supplier may reprint or refund the affected goods at its discretion.
7.3 Goods that have been customised or printed according to the Customer’s specifications (especially artwork) cannot be returned for a refund unless they are proven faulty.
7.4 These rights are in addition to the Customer’s statutory rights.
8. Intellectual Property and Licence
8.1 The Supplier retains all intellectual property rights in designs, templates, or materials created by the Supplier unless otherwise agreed in writing.
8.2 The Customer warrants that any artwork supplied does not infringe any third-party rights and agrees to indemnify the Supplier against any claims relating to infringement.
9. Limitations of Liability
9.1 Except where prohibited by law, the Supplier’s total liability under or in connection with these Terms shall not exceed the total fees paid by the Customer for the goods/services giving rise to the claim.
9.2 The Supplier shall not be liable for indirect, consequential, or special loss, including loss of profits.
10. Data Protection
10.1 The Supplier will process Customer personal data in accordance with applicable UK GDPR and privacy law. Customer consents to the use of their information for order fulfilment and communication.
10.2 The Supplier will not share Customer personal data with third parties except as necessary to fulfil orders or as required by law.
11. Applicable Law and Jurisdiction
11.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
11.2 Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the English courts.
12. General
12.1 No variation of these Terms shall be effective unless agreed in writing by both parties.
12.2 If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force.
